Immigration News Round-Up: Week of July 29, 2024
*Usual disclaimer: not exhaustive of Canadian immigration updates this week. Just links/news we found notable, in no particular order.
Canada Border Services Agency (CBSA) News: CBSA issues tips for travelling over the August long weekend.
Definition of “Work”: (Technically US news but still something to think about in Canada.) US turns away Canadians with plans to house-sit.
Judicial Review (JR):
Article 1F Exclusion from Refugee Protection: JR granted where Federal Court finds Refugee Protection Division (RPD) misconstrued the Ezokola test for “culpable complicity”.
^ For those with a particular interest, arguably worth a click for the Lord Denning quote at para 23.
Procedural Fairness: JR granted in RPD re-opening matter following an abandonment decision. RPD failed to address Applicant’s submission that it should have tried to contact him through the email address on file.
Inadmissibility for Serious Criminality: JR granted in Immigration Division (ID) matter with an inadmissibility finding based on serious criminality. Decision failed to meaningfully address the defence of impossibility.
(Included in this list largely for equivalency discussion about US and Canada firearms offences.)
